Lindsay Lohan has been released from jail
The troubled actress – who was yesterday (24.09.10) sentenced to four weeks in prison for violating the terms of her probation – is now free after posting her $300,000 bail, which was granted after her attorney Shawn Chapman Holley launched an appeal claiming she was unlawfully denied it.
Los Angeles Sheriff’s spokesman Steve Whitmore said: “She’s been very cooperative – always has been – the first time, and then the last time. Let’s hope this is the last time.”
Judge Patricia Schnegg overturned Judge Elden Fox’s initial ruling she must stay behind bars until her next court appearance on October 22.
Although Lindsay is a free woman, the judge ruled she must be fitted with a SCRAM alcohol-monitoring device within 24 hours if released.
Lindsay – who served just 13 days of a 90-day jail term in July for violating the probation terms of a 2007 conviction for driving under influence (DUI) – was sent back to prison after she failed two court-ordered drug tests, testing positive for cocaine and amphetamine abuse.
It was widely believed Judge Fox would send the 24-year-old star back to rehab, rather than prison.
However, he made his decision without hearing arguments from lawyers on either side.
Lindsay was said to look “shocked” and glanced at her attorney upon hearing the ruling, before being escorted out of the courtroom in handcuffs.
Lindsay spent just 22 days of a 90-day court-ordered rehab stint following her release from prison in August.

Lindsay Lohan’s lawyer, Shawn Chapman Holley, is at the Beverly Hills courthouse right now … and we’re hearing the doctors may have weighed in on releasing LiLo early.
Holley is in the courtroom and the judge is about to take the bench.
As we first reported Lindsay’s doctors at UCLA have decided she’s not as bad off as first thought and she will almost certainly be released early.

Turns out Lindsay Lohan will indeed be getting out of the UCLA Neuropsychiatric Hospital … as early as this week, according to sources familiar with the situation.
Our sources say Lindsay’s doctors have not written their final report, but they have already concluded her psychiatric problems are not nearly as severe as first thought. We’ve been told there were indications Lindsay was bipolar but that proved not to be the case.
In addition, the doctors do not believe the drug dependency issues are as severe as first thought. As we reported, Lindsay had big issues with Adderall, but the docs don’t think it requires much more inpatient care.
Bottom line … sources say it’s “very possible” Lindsay is getting out this week and will begin getting outpatient care.
One obstacle – the judge must approve early release. We’re told once the doctors write their final report, Lindsay’s lawyer, Shawn Chapman Holley, can go back into court and ask the judge to spring her client from her 90-day rehab sentence.
If the medical professionals think releasing her is a good idea, the judge will almost certainly go along with it.

TMZ has learned Lindsay Lohan is being treated at UCLA’s Neuropsychiatric Hospital during her court ordered 90-day stay in rehab.
As TMZ first reported Lindsay is being treated for both psychiatric and substance abuse issues.
There have been rumblings that she is being weaned off Adderall, but her lawyer Shawn Chapman Holley tells TMZ, “The medical professionals at the treatment program are taking a fresh look at Lindsay Lohan and will evaluate which if any prescription drugs are appropriate or not. Under no circumstance is she being weaned off Adderall.”
As TMZ first reported officials at Morningside Recovery — where the judge initially wanted Lindsay to go — documented that Lindsay would be treated for “methamphetamine” use and “bipolar disorder.”
Chapman Holley tells TMZ, “I am not aware of Morningside’s assessment, and as we know she is not at Morningside.”

Kim Kardashian claims her alleged stalker is trying to get back into her life — via Twitter — and TMZ has learned she’s now going to the cops to try and protect herself … and her NFL boyfriend Miles Austin.
Sources close to Kim tell us the reality star is “freaked out” … because the man she has a restraining order against, Dennis Shaun Bowman, has been recently ranting about her on Twitter and sending messages to Miles and her sister Khloe.
Kim and her lawyer, Shawn Chapman Holley, believe the tweets could be a violation of the restraining order that’s already in place against Bowman.
Chapman Holley tells us, “I will be speaking with law enforcement detectives … to determine whether or not Mr. Bowman’s actions are a violation of the order in place restricting Mr. Bowman’s conduct toward Ms. Kardashian.”
As TMZ previously reported, a judge granted Kardashian’s request for a restraining order back in February — which means dude isn’t supposed to have any contact with her until 2013.

TMZ has learned Judge Marsha Revel ignored the advice of Lindsay Lohan’s court appointed psychiatrists by ordering Lindsay to enter the Morningside rehab facility in Orange County.
Sources familair with the case tell us the two psychiatrists — selected by Judge Revel — recommended four facilities, including UCLA Medical Center. Morningside was not on the list.
We’re told several medical experts informed the judge UCLA was particularly well-suited to handle Lindsay because she needs to be treated for psychiatric and substance abuse issues — both specialties at UCLA. Medical experts told the judge they could tailor a program at UCLA that could be especially effective — but the judge would have none of it.
But we’re told the judge rejected their recommendation and instead heeded the advise of a probation officer who favored the Morningside facility headquartered in Newport Beach. As we first reported, Lindsay will be at a satellite compound in nearby Costa Mesa.
Sources say David Gates, COO of Morningside Recovery, made a push to get Lindsay as a patient by assuring the judge he would actually be tougher on Lindsay than the average patient … by cutting off communication between Lindsay and the outside world.
Lindsay’s lawyer, Shawn Chapman Holley, declined to comment on this story.

Lawyers to Lindsay: How Was Your Strip Search?
If Lindsay Lohan got strip searched at Lynwood Correctional Facility a couple of lawyers want her to spill every detail of the experience in a deposition.
TMZ has learned Lindsay’s name just got dragged into a class action lawsuit that alleges unlawful strip and body cavity searches were conducted by L.A. County Sheriff’s deputies when another inmate — not Lindsay – checked into the jail.
Attorneys for the plaintiffs filed a request in Federal Court on Monday to take Lilo’s deposition while she’s behind bars. They also sent a letter to Lohan’s attorney Shawn Chapman Holley asking if Lindsay would agree to be deposed.
The suit claims that female inmates are strip searched in plain view of each other in a parking lot that is neither private nor sanitary.
Sheriff’s officials have said Lindsay was treated just like any other inmate when she arrived at the jail.
So, will Lindsay tell all? Chapman Holley hasn’t gotten back to us yet.

Lindsay may not be the only Lohan that gets cuffed and taken away this morning. If Michael Lohan gets too close to Dina, he could end up behind bars.
Dina told TMZ last week … she didn’t attend the last hearing because she didn’t want to make things worse by having Michael arrested for violating a restraining order.
Michael has been ordered by the court to stay clear of Dina. They’re both going to court today for Lindsay, and Michael has made sounds about confronting Dina. If he gets too close, it could get ugly quick.

TMZ has learned … Shawn Chapman Holley is going to be by Lindsay Lohan’s side in court this morning, representing her after Robert Shapiro bailed on LiLo.
TMZ broke the story … Holley quit earlier this month, because Lindsay was an uncontrollable client.
But now Lindsay is in a pinch, and Holley is stepping up.
Sources tell us Lindsay is furious at Shapiro, feeling as if he totally used her to get publicity for his sober living house. She believes that is the only reason he agreed to rep her and sold her a bill of goods.
We’ve learned Holley is supposed to be in court in the Juan-Carlos Cruz attempted murder case at the same time Lindsay’s case is heard. We’re told Holley is going to have the Cruz case delayed so she can be with Lindsay.

People who are interacting with Lindsay tell TMZ she has been in obsessive denial over her surrender Tuesday, when she must begin serving a 90-day jail sentence — which will be whittled down to 22 days behind bars.
Lindsay is convinced there is still a way she can avoid jail, even though Shapiro made it clear he would only rep her if she went to the pokey.
Here’s the irony — Lindsay expects Shapiro to pull a Shawn Chapman Holley … code for getting the judge to overlook her past screw-ups and keep her a free woman. Holley eventually quit when Judge Marsha Revel made it clear … there were no more cards to play.
And, we’re told, the reason it took so long to find a new lawyer is because Lindsay only wanted someone who could keep her out of jail but no credible lawyer would make that promise.
And here’s the thing. From what we’re hearing, there is no way in hell Judge Revel is going to back down.

Lindsay Lohan can’t find a lawyer to save her life.
Sources connected with Lindsay tell TMZ LiLo and mama Dina have been interviewing potential lawyers like crazy but, we’re told, “They are suspicious of their (the lawyers’) motives.”
We’ve learned Lindsay is now talking to former O.J. Simpson lawyer Robert Shapiro, but she has not hired him.
Short story — Lindsay is due to surrender in Judge Marsha Revel’s court on July 20 to begin a 90-day jail sentence. We broke the story … Shawn Chapman Holley quit the case but has not been excused by Judge Revel, because there’s no lawyer to take her place.
Holley — a seasoned attorney but not a magician – could get the judge to formally excuse her before the 20th.
One way or the other, unless Lindsay wins a delay, she had better show up on the 20th or the judge will issue a bench warrant. Been there, done that.

Lindsay Lohan has not decided on a new lawyer yet, but hopes to have one by next week … this according to her lawyer in New York.
As we first reported, Shawn Chapman Holley resigned as Lindsay’s lawyer just days after Lindsay was sentenced to 90 days in the pokey.
Stephanie Ovadia, who is representing Lindsay in her lawsuit against E*TRADE, tells TMZ they are still interviewing lawyers and “no attorney has been retained.” She added that they hoped to have one chosen in the next couple of days.
Sources close to Lindsay have told us she has vowed to appeal her sentence.

Sources tell TMZ … Lindsay Lohan vows to appeal Judge Marsha Revel’s 90-day jail sentence.
One source who was with Lindsay last night says LiLo proclaimed, “I’m not going to jail!” Lindsay was talking with people in her apartment about appealing the case.
As for how Lindsay could appeal … the only real basis is arguing that Judge Revel abused her discretion in nailing LiLo with a 90-day sentence. The chances of winning such an appeal are extremely remote under the best of circumstances, and given Lindsay’s performance on probation … snowballs and hell come to mind.
Lindsay’s vow to appeal could explain why Shawn Chapman Holley just threw in the towel and resigned.
We’re told Lohan’s new attorney, Tiffany Feder-Cohen, has already been in touch with the Sheriff’s Department.

TMZ has learned … Lindsay Lohan’s lawyer, Shawn Chapman Holley, has resigned as LiLo’s lawyer.
TMZ called Holley for comment on a story we’re working on, and she informed us she is no longer repping Lindsay. Sources tell us Holley resigned earlier today.
As for who Lindsay will be hiring … we’re told she’s a brand new lawyer, Tiffany Feder-Cohen, who was just admitted to the bar in November.
As for what Lindsay wants her to do … stay tuned. We’ll tell you shortly.

Lindsay Lohan tested positive for amphetamines and opiates during her random drug tests, this according to the probation officer’s report obtained by TMZ.
But according to the report, Lindsay was allowed to take the drugs that created the positive results — namely, Dilaudid (opiate) and Adderall (amphetamine).
According to the report, “The defendant indicates she has been on the same prescription medication for as long as she can remember.”

Sources connected with Lindsay Lohan’s case tell TMZ LiLo twice placed a foreign object between her skin and her SCRAM, to obstruct any alcohol reading.
We’re told the night of the MTV Movie Awards — when her SCRAM registered more than a .03 blood alcohol level – Lindsay allegedly tampered with the device in order to block the reading.
Sources say days later Lindsay tried obstructing her SCRAM again.
We’re told the data registered by the SCRAM device reveals tampering, and the data from Lindsay’s SCRAM clearly shows the two tampering attempts.
Lindsay’s lawyer, Shawn Chapman Holley, tells TMZ, “Lindsay adamantly denies tampering with the device. There are a number of people who were with her who could attest to the fact that she never tampered with her bracelet and there are well-documented problems with the SCRAM bracelet and the accuracy of its readings.”

Lindsay Lohan could go to jail Tuesday for violating her probation … but even though she’s positive Judge Marsha Revel hates her, she’s convinced she’s does nothing wrong and will not end up behind bars.
Multiple sources close to Lindsay tell TMZ … as far as Lindsay’s concerned, any missteps she may have made in the past are completely cured. She’s now up to date on all her alcohol ed classes, so, she thinks, what’s the big deal?
What Lindsay does not understand is that Judge Revel could indeed throw her in the pokey for missing three alcohol ed classes as of her last court appearance. And the whole thing of not showing up in court because the dog/thief ate her passport could be a deal breaker as well.
The people close to her tell us … Lindsay has become so accustomed to good lawyers bailing her out of seemingly impossible situations, she simply expects the same thing to happen again.
As one source put it, “Shawn [her lawyer, Shawn Chapman Holley] will just fix this like everything else.” The source adds, “It’s no big deal to her, even though she totally believes Judge Revel hates her guts.”
But even if Lindsay gets thrown in the pokey, people close to her think she’d be fine. As one source put it, “She is one tough bitch. She can hold her own.”

Nicole Richie Probation Extended Because of Babies
TMZ has learned … Nicole Richie’s probation was just extended by a year, because she’s been so preoccupied with her kids, she hasn’t taken the required number of alcohol ed courses.
Nicole is on probation because of her 2006 DUI, when she was arrested after driving the wrong way on an L.A. freeway.
Nicole’s probation was due to terminate next month, but today in court, her lawyer, Shawn Chapman Holley, explained to the judge … because she had program-approved leaves of absence in order to deliver and care for her two kids, she didn’t complete the required number of alcohol ed courses.
So Nicole’s probation was extended until March, 2011.
The judge said he would terminate her probation earlier if she completes the alcohol ed program before March.
The alcohol ed report gives Nicole high marks, noting, “Her attitude is excellent.” Hear that Lindsay?

Lindsay Lohan’s lawyer, Shawn Chapman Holley, tells TMZ Lindsay’s SCRAM bracelet “indicated the presence of a small amount of alcohol on Sunday night.”
Holley added, “Having just received the report, I am not in a position to speak to its accuracy or validity, however, Ms. Lohan maintains that she has been in complete compliance with all of the terms of her probation and her bail.”
So either SCRAM is inaccurate, or Lindsay ain’t fessin’ up. Ultimately, it’s Judge Marsha Revel’s call on July 6 — or before, if Lindsay goes astray.

TMZ has done some digging, and it turns out Lindsay Lohan is effectively free to drink as she pleases, provided she’s willing to pay $10,000 for a vodka on the rocks.
The man who posted Lindsay’s bail yesterday — David Perez — tells TMZ Lindsay didn’t really forfeit her $100,000 bail. The judge just applied the $100,000 to the new, enhanced bail, adding another $100,000 on, thus forcing Lindsay to pay an additional 10% premium to Perez. So Lindsay has really lost nothing, other than having to pay a total of $20,000 to the bail bondsman.
If the SCRAM people tell the judge Lindsay is drinking again, the judge will go through the same drill. Judge Revel can’t revoke bail altogether and throw Lindsay in jail … because the case involves only a misdemeanor. As long as Lindsay keeps paying the increased premium, she’ll be free.
Bottom line … if Lindsay wants to keep drinking, it will probably cost her $10,000 a pop.
One more twist. Even though Lindsay is insisting she wasn’t drinking Sunday night, it won’t do her any good to get Shawn Chapman Holley to challenge it. Even if Holley can convince the judge the SCRAM reading was bogus, all the judge would do is cancel the $200,000 bail and go back to the $100,000 bail. So Lindsay would get $10,000 back, but it would probably cost $25 grand in legal and expert fees.

Possible Plea Deal in Murder-for-Hire Case
TMZ has learned …Juan-Carlos Cruz could cop a plea in his attempted murder case as early as June 23.
We’ve learned … last week a Santa Monica detective approached the three homeless men whom Cruz allegedly tried to hire to kill his wife. We’re told the detective expressed his displeasure that the men had spoken with TMZ about the case. One of the men tells TMZ … the detective said, “You can’t talk about the case until the plea bargain happens on June 23.”
Turns out … Cruz’ case is indeed in back in court June 23, and as we first reported the prosecutor and Cruz’ lawyer, Shawn Chapman Holley, are already in plea bargain negotiations.
TMZ broke the story … cops and prosecutors believe Cruz’ story … that his wife, Jennifer Campbell, had been suicidal for years over the fact that they could not have kids, but she could not take her life because of her religious beliefs. Cruz told cops … killing his wife was supposed to be an act of mercy, which would be followed by Cruz taking his own life.
Law enforcement sources tell us the D.A. does not believe the case should go to trial. We’re told the likely resolution is a no contest plea to solicitation to commit murder, which carries a 3 – 9 year sentence. If Cruz gets 3 years, he could be out in half that time.
Neither the prosecutor nor defense would comment on a possible plea deal on June 23.

It might seem like bad timing — that Lindsay Lohan was ordered last week to submit to random drug testing, just days before she had her wisdom teeth pulled … but we’ve learned Lindsay got a pass from probation.
Lindsay’s lawyer, Shawn Chapman Holley tells TMZ, “We advised the Probation Department of the dental appointment, which was made well in advance of last week’s court hearing.” Chapman says she assured the probation officer she would provide “documentation about any medications that Lindasy would be taking, which would be administered or prescribed as part of the procedure.”
So whatever sedative Lindsay got in the oral surgeon’s office, and whatever she’s taking for the pain … won’t count on the drug test.
