Pete Wentz and Ashlee — Custody Battle Underway

Pete Wentz does NOT want his soon-to-be-ex wife Ashlee Simpson to get primary physical custody of their 2-year-old son Bronx — as she’s requested — and now he’s taking her on in court … TMZ has learned.

Wentz just filed legal papers in response to Ashlee’s divorce petition … asking the judge for JOINT physical and legal custody of their son. In her divorce petition, Ashlee checked the box that indicated she wanted primary physical custody.

According to the docs, filed in L.A. County Superior Court and obtained by TMZ, Wentz also wants each party to pay their own legal fees … even though Ashlee asked the court to make Pete foot the bill for both sides.

And while Ashlee didn’t specify the official break-up date in her papers — Pete says the two called it quits on Feb. 9 … just days after Pete came home from a wife-less trip to Dallas for the Super Bowl.

Ashlee Simpson-Wentz has filed for divorce from Pete Wentz

The ‘Outta My Head’ singer – who has a two-year-old son Bronx Mowgli with the former Fall Out Boy rocker – cited “irreconcilable differences” in a filing to Los Angeles County Superior Court, but the pair insist they are still friends.

In a joint statement, they said: “After careful consideration, we have made the difficult decision to file for divorce.
“We remain friends and deeply committed and loving parents to our son Bronx, whose happiness and well-being remains our number one priority. We ask that everyone honour our privacy as we navigate this next phase of our lives.”

In her petition to the court, Ashlee, 26, is asking for joint legal custody and primary physical custody of Bronx

The couple married in May 2008 after around a year of dating.

It is not believed they had a prenuptial agreement.

Just last month Pete, 31, spoke about how much he was looking forward to going on the road with his new band Black Cards and taking his family with him.

He said: “The great thing right now is that my family is very mobile and are able to tour with me. And I think that’s the only thing that would’ve been a hurdle. But the fact they’re kind of able to go, I want to be back out there.

“And it’s really cool to be able to see the world and to do it on a record company’s dime, so I’d like to kind of do that and I’d like to show my son the world as well.”

Miss California USA Says NOH8

Following in the footsteps of pageant co-director Shanna Moakler, Miss California USA 2010 Nicole Johnson has posed for the NOH8 campaign — and we got the first look at her shot.

Looking flawless with her crown, Johnson was photographed for the cause, which aims to overturn California’s Prop 8 ban on gay marriage.

Other celebs who have taken part in the campaign include Jane Lynch, Ashlee Simpson, Pete Wentz, Kim Kardashian, “Lost” star Michael Emerson, Kristin Cavallari and Cindy McCain.

The 25-year-old singer, who is married to musician Pete Wentz, is looking forward to treating her husband on the romantic day as well as getting a surprise from him.

She said: “Every Valentine’s Day is sweet. Pete’s very creative, so he’s always coming up with something clever and surprising me. Hopefully, I’ll surprise him this year.”

As well as looking forward to Valentine’s Day, Ashlee also looks forward to seeing what 15-month-old son Bronx will do next.

She told America’s OK! magazine: “I love being a mother. We’re together all the time. Bronx is definitely finding himself, and he’s getting his own personality, so hide-and-seek, and new little things. He does sign language, so that’s been fun.”

Meanwhile, Pete has revealed his seemingly defunct band Fall Out Boy could reunite.

The 30-year-old musician said: “We just haven’t had the time to say anything. All I have been able to do is say, ‘Man, I miss doing Fall Out Boy,’ and I got to a better place hanging out with my son.

“Now I’m OK if Fall Out Boy comes back or doesn’t come back. Like, if it’s fun for everyone to do again, we’re going to do it… I just want it to be authentic when we come back.”

Bronx Mowgli – who actually turned one on Friday (20.11.09) – was treated to a ‘SpongeBob SquarePants’-themed bash at his grandparents Joe and Tina Simpson’s house in Encino, California, which even included an impersonator dressed as the goofy, yellow sea sponge.

Pete thanked his friends and family on Twitter for a “rad b-day for Bronx. (sic)”

The tot was joined by 30 family and friends – including his pop star aunt Jessica Simpson – who tucked into birthday cake and played on a giant bouncy castle.

Last week, Pete revealed his plans behind opting for the cartoon theme.

He said: “Bronx likes Bob and he likes guitar – which he calls ‘itar’ so we’re going to have a SpongeBob party for him.”

Pete was not Bronx’s only family member to talk about his birthday celebration on Twitter.

Ashlee wrote: “BX’s 1st bday tomorrow! My angel is going to be a year!! The greatest year of my life.(sic)”

Jessica added: “Happy Birthday to my precious angel on earth!!! Bronx is 1 today!! I LOVE HIM SO MUCH!!! I can’t believe it has been a year already. (sic)”

The singer-and-actress admits her body has changed since giving birth to the couple’s 11-month-old son Bronx but knows the Fall Out Boy rocker still finds her attractive.

She said: “Pete isn’t worried about stretch marks. He always makes me feel sexy.

“There’s going to be a time when I’m way curvier, and that’ll be sexy too. What defines sexy is not someone’s weight. Personally I like curves… I want to look good for me. I want to feel good.”

Ashlee, 25, says she gets regular exercise by carrying Bronx around all the time.

She said in an interview with Women’s Health magazine: “I do Bronx Pilates! And these biceps are from holding him. He’s in my arms all the time.”

Ashlee also revealed being a wife and mother has “humbled” her and everything else comes second to her family.

She said: “Being married made me able to share more. Now Pete and Bronx come first. It has humbled me.”
