Mel Gibson Shut Down Over TMZ Story

Mel Gibson lost a round in court after arguing that Oksana Grigorieva should be stripped of custody because she allegedly leaked info to TMZ.

Sources connected with the case tell us … Mel’s lawyers argued to Judge Scott Gordon last week … Oksana was not acting in the best interests of Lucia by allegedly telling TMZ what she said during her deposition.

TMZ broke the story … Oksana claimed during her deposition that Mel beat her during sex.

Grigorieva denied leaking the info to us — and Mel’s lawyers responded by getting declarations from everyone else in the case stating they weren’t the leak … so, they said, it had to be Oksana.

In the end, Judge Gordon told everyone to go home, insisting who-leaked-what was irrelevant to child custody.

Judge Orders Oksana’s Key Guy To Stay Clear of Lucia

Mel Gibson’s lawyers just got a judge to order Oksana Grigorieva’s bodyguard/key adviser to stay away from baby Lucia … TMZ has learned.

Judge Scott Gordon issued a restraining order against Oksana’s confidante, Kristian Otto Herzog, after Mel Gibson’s lawyers claimed he’s a danger to Mel’s daughter.

As we first reported … Herzog is a twice-convicted felon — each case involving firearms. He was released from jail in March after serving 255 days. He is currently on probation.

We’re told Mel had asked Oksana to keep Herzog away from Lucia … but she refused. So today Mel’s lawyers asked Judge Scott Gordon for a restraining order … which has been granted.

Mel Gibson and wife Robyn never thought in a million years that one of them would have a child during their marriage with another partner … and that’s why baby Lucia created a big problem.

Sources tell TMZ … Mel and Robyn created the Icon Trust to provide financial security for their kids. But when the trust was drafted, it defined “issue” (a fancy name for children) as kids born from Mel or Robyn, not Mel and Robyn.

So then Mel goes and gets Oksana Grigorieva pregnant and baby Lucia is born. Lucia is automatically a beneficiary under the trust … something that was never contemplated or intended. We’re told Mel, Robyn and their 7 kids all love Lucia and want to provide for her, but including Lucia in the trust would create major tax issues.

So … fast forward to the mediation between Mel and Oksana — the very first term in the agreement states, “Oksana consents to amendment of Icon Trust to exclude Lucia.” Oksana agreed, partly because under the mediation agreement, upon Mel’s death, Lucia will receive “no less than $4.3 million … in addition to the … $2 million life insurance policy.”

But … if Oksana can successfully disavow the mediation deal, it could throw a major monkey wrench into the Icon Trust.

Oksana Grigorieva signed a “Child Custody” agreement in May which spelled it out as clearly as can be — Mel Gibson was not only entitled to unsupervised contact with Lucia, he was getting joint legal and physical custody of the child.

The document, obtained by TMZ, was signed by Oksana and Mel on May 16 … but disavowed by Oksana shortly thereafter. She claimed she did not know the agreement gave Mel unsupervised contact with the baby.

But the agreement laid out in almost painful detail the schedule for custody, down to the day and the hour. Mel immediately got joint legal custody of the baby. He also got significant unsupervised visitation, which turned into 50/50 custody when Lucia turned 3.

The agreement also provided, when Mel didn’t have Lucia, the nanny would coordinate a Skype call between himself and the child.

The agreement spelled out who gets the kids on holidays. But these pages, which were initialed by both Mel and Oksana, were X’d out. We’re told a similar schedule was later substituted for the one you see.

It was the Father’s Day visitation that sent the case into family court, when Oksana refused to let Mel have the baby.

Oksana’s lawyer, Dan Horowitz, had no comment.

Oksana Says Goodbye to Important Witness

TMZ has learned … Oksana Grigorieva is currently attending funeral services for a close friend of hers  … a friend who also happened to babysit for Oksana and Mel Gibson’s daughter Lucia … and may have had some critical information about Mel.

As we previously reported, the babysitter had claimed that she was at Mel’s home on January 6th — and allegedly heard the actor go crazy while Oksana was at her son’s basketball game.

The woman — who died after battling cancer — claimed to have heard part of the explosive argument between Mel and Oksana later that day, but claims she left before any alleged blows were struck.

And … we’re told the babysitter never gave a sworn statement to police or the lawyers regarding the incident … because she claimed she was sick and had other things on her mind.

Baby Talk in Mel Gibson Court Case

TMZ has learned the financial needs of baby Lucia were front and center yesterday in the Mel Gibson/Oksana Grigorieva custody hearing.

We’re told yesterday’s marathon court hearing involved a request by Oksana Grigorieva and her lawyers to increase Mel Gibson’s child support payments.  Sources say Mel’s lawyers argued the kid is 9 months old and doesn’t need more than Mel is paying — we’re told $5,000 a month plus other living expenses.

In the end, Judge Gordon decided not to decide on the spot, but to think it over.

There was a notation on the court docket plastered on the door of the courtroom that the issue of Lucia’s passport was on calendar, but we’ve learned the matter never came up.

As for Mel’s deposition … sources tell us a date still has not been set.

Oksana to Be Deposed in Child Custody Case

TMZ has learned Oksana Grigorieva will take the oath — swearing to tell the truth tomorrow when she is deposed in the child custody dispute with Mel Gibson.

Sources tell us Oksana and her attorneys will meet with Mel’s attorneys.

This could be tricky for Oksana because although the primary focus will be custody of Lucia, the topic of the tapes will most likely come up — the recording and sale of them. Oksana could invoke her Fifth Amendment rights and refuse to talk about that subject.

Mel Gibson’s Lawyer: Oksana Full of Lies, Deceit

Mel Gibson’s lawyer claims Oksana Grigorieva is making up horrible stories about Mel because she’s having buyer’s remorse over a custody agreement she signed.

Stephen Kolodny tells TMZ … what’s really behind Oksana’s spate of new allegations — that he punched her twice in the face last January, knocking out her teeth and giving her a concussion — is sour grapes over the custody arrangement to which she agreed.

TMZ broke the story … Oksana went to court last Monday and got a restraining order prohibiting Mel from getting near Oksana or their daughter, 8-month-old Lucia. The next day, Mel’s lawyer went to court and got the judge to modify the order, allowing Mel to have contact with the baby.

Kolodny claims, by modifying the order, the court rejected Oksana’s argument that the baby was in any danger and affirmed their recent custody agreement.

Kolodny says, “Oksana’s deceitful conduct in trying to terminate Mel’s access to his daughter continues.”

Sources connected with Oksana claim she believes Mel is “extremely violent” and poses an ongoing threat to her and the baby.

Kolodny scoffs at the claim, adding, “Having entered into an agreement that allows for overnight, unrestricted visitation, and would soon result in Mel having 50/50 custody of their daughter — an agreement reached after a two-day mediation with two retired Superior Court judges, Mel was hopeful that their break-up was behind them and Lucia would be the beneficiary of cooperative parenting. Apparently Lucia will be denied that good fortune.”

And for a finishing touch, Kolodny says, “Making sensational allegations is not the way to resolve this,” adding Mel wants a custody settlement or a resolution in court, not the media.

Mel Gibson: She’s Lying and She Secretly Taped Me

Mel Gibson’s baby mama Oksana Grigorieva was bitter over a custody agreement she signed, and that’s why she made up the story that Mel beat her up … this according to sources connected with the actor.

TMZ broke the story … Oksana’s lawyers went to court last Monday and got a domestic violence restraining order against Mel after telling the judge Mel beat Oksana up last January.

According to sources connected with Mel, on January 6, 2010, Mel and Oksana were arguing at home when Oksana took baby Lucia, ran around the backyard, threw herself on the ground, came back inside the house and began shaking Lucia like a ragdoll. Mel followed and the sources acknowledge there was physical contact, but insist Mel did not punch her and was just trying to protect the baby.

The sources say Oksana began traveling the world with Mel and made no mention to anyone about being the victim of brutality at the hands of M.G.

In May, after the couple split, there was a mediation in which Mel and Oksana got joint legal custody of Lucia – Oksana got primary physical custody and Mel got visitation, which included overnights. The deal was … the arrangement was eventually supposed to turn into 50/50 custody.

On one occasion, while Oksana was touring Russia for her singing career, Mel went to her house to see Lucia. Oksana’s mother was there and told him to stay overnight with the child, which he did. Oksana’s mother even let the bodyguard go for the night. Oksana had no problem with this, sources say.

Sources connected with the couple tell TMZ Oksana regretted agreeing to the mediated custody settlement and wanted to limit or even exclude Mel’s contact with Lucia.

A week ago Friday, Mel’s representatives got a call from Oksana’s lawyer, saying Oksana would not allow Mel to spend time with Lucia on Father’s Day … something to which she had already agreed.

According to sources, at noon on Monday, Oksana’s lawyer called Mel’s rep and said she got a restraining order against him to stay 100 yards from her and couldn’t even see Lucia until a hearing in July.

The next day, Mel’s lawyer went to the judge and got the restraining order modified, allowing him to see Lucia — just like it was agreed before.

During the hearing, it came out that Oksana had secretly taped arguments she had with Mel. The judge ordered the tapes sealed and also ordered Oksana not to talk publicly about the recordings.

And, we’re told, the judge was extremely unhappy with Oksana’s lawyer for not revealing that there had been a mediated custody agreement in place.

Mel Gibson allegedly cheated on ex-girlfriend Oksana Grigorieva while she was pregnant with their daughter.

Porn producer Violet Kowal claims to have had a three-month fling with the ‘Mad Max’ star last year, with the reported romps happening at his Malibu home and office in Santa Monica.

The 26-year-old Polish filmmaker told National Enquirer magazine: “Mel’s break-up with Oksana doesn’t surprise me at all. Clearly, Mel can’t commit to just one woman.”

Violet was also very impressed with 54-year-old Mel’s skills in the bedroom department, saying: “Mel’s great in bed! It was the best sex I’ve ever had!”

Although Mel’s lawyer has branded the story “an absurd fabrication”, Violet is said to have passed a lie detector test.

Oksana gave birth to Lucia last November but she and Mel announced their split just five months later.

While she has refused to give the real reasons behind the break-up, the Russian musician has previously hinted there would be some shocking revelations.

She said: “I can tell you that we have split up, suddenly and recently. Unfortunately, I cannot give you the reason. But you will find out everything quite soon.

“Here is the official version – we split up by mutual consent and we will raise our daughter together. She is currently with my mother in my Los Angeles home.”

Despite initial reports insisting they are still on good terms, it was recently claimed Mel ended their relationship following a huge row after Oksana accused him of cheating.

Mel has seven children with estranged wife Robyn, who filed for divorce last May.

Following the legal proceedings, it emerged the couple had been separated for some time and the actor was in a relationship with Oksana, who has 12-year-old son Alexander with ex-boyfriend Timothy Dalton.

The ‘Braveheart’ actor and the Russian singer reportedly “drifted apart” but have pledged to remain friends for the sake of their five-month-old daughter Lucia.

A source told People magazine: “They just drifted apart. They’re both working hard on their careers and trying to raise a sweet baby together. They’re still friends and they’ll both raise Lucia together.”

Despite reports insisting they are still on good terms, it has also been claimed 54-year-old Mel ended their relationship following a huge row.

According to National Enquirer magazine, 40-year-old Oksana accused her partner of “cheating” and “lashed out” over his reluctance to marry.

A source said: “After the row Mel told Oksana it was over.”

Mel has previously admitted he didn’t intend to marry the brunette beauty.

He said recently: “She’d make anyone a wonderful wife, but for the moment, she’s a mother.
