Lindsay — Probation Dept. Unswayed By Rehab Stint
Lindsay Lohan’s voluntary stay at the Betty Ford Center isn’t impressing everybody — TMZ has learned the L.A. County Probation Dept. still wants LiLo to serve at least 30 days behind bars for her failed drug test.
Law enforcement sources tell TMZ the Probation Dept does not want Judge Elden Fox to cut LiLo a break during her probation violation hearing today … and will recommend that she serve at least 30 days in jail for testing positive for cocaine after she left her court-ordered rehab stint at UCLA.
The Probation Dept. carries some pretty powerful influence — but in the end, the decision will be up to Judge Fox.
The hearing is set to begin today at 8:30 AM PST — and we’ll be streaming the whole thing live.

Lindsay — Going to Court, Begging for Rehab
Lindsay Lohan will obey the judge’s order – no small feat — to be in court this Friday … and TMZ has learned Sheriff’s deputies are ready to take Lindsay back to jail, if necessary.
Law enforcement sources tell us LiLo will indeed leave the Betty Ford Center – where she’s been in treatment since September 27 — to attend her probation violation hearing for a failed drug test. Judge Elden Fox had ordered Lindsay to be in court, but we know how that’s gone in the past.
A source says Lindsay’s legal team won’t dispute the violation of probation … but they’re hopeful Judge Fox will send Lindsay back to rehab and not to jail because any interruption would severely disrupt her treatment, and she “has come a long way” during her time at Betty Ford. We’re told Lindsay is ready and willing to stay in rehab for as long as Judge Fox wishes.
Just in case though — the L.A. County Sheriff’s Department has a plan in place to take her to jail. We’re told deputies, both undercover and in uniform, will be in the courthouse with a vehicle warmed up and ready to take Linds to Lynwood Correctional Facility … where she could be sentenced to a minimum of 30 days.

Lindsay Lohan — No Time Limit for Rehab
Lindsay Lohan will definitely be in rehab at least until her court appearance later this month — but how long she stays after that will probably be determined by the judge.
Sources tell us … the plan is for Lindsay to stay in rehab at least until her October 22 court appearance before Judge Elden Fox. As for how much longer she stays … we’re told by the time of the hearing, Judge Fox will have docs from the doctors at Betty Ford, evaluating Lindsay’s problems and progress.
If the judge determines Lindsay would be better served with rehab than jail, it’s all but certain her stay will be extended.
As for the October 22 court appearance, Lindsay does not have to show, because in misdemeanor cases lawyers can appear on behalf of the client. But … Judge Fox clearly thought Lindsay would be present since he assumed she’d be in custody until the hearing … so it’s a good bet she’ll be there.

Lindsay Lohan Chooses Rehab
TMZ has learned Lindsay Lohan is about to re-enter rehab … and it’s her decision.
Sources with direct and specific knowledge of the situation tell TMZ Lindsay will enter a live-in facility outside of Los Angeles within days. Lindsay is now agonizingly aware she has an addiction problem and also acknowledges the reality — addicts often backslide before they get better.
We’re told Lindsay is telling people she doesn’t want this type of life anymore. She says she wants to get better and wants to do whatever it takes at this point … irrespective of what Judge Elden Fox does to her.

Lindsay Lohan has been released from jail
The troubled actress – who was yesterday (24.09.10) sentenced to four weeks in prison for violating the terms of her probation – is now free after posting her $300,000 bail, which was granted after her attorney Shawn Chapman Holley launched an appeal claiming she was unlawfully denied it.
Los Angeles Sheriff’s spokesman Steve Whitmore said: “She’s been very cooperative – always has been – the first time, and then the last time. Let’s hope this is the last time.”
Judge Patricia Schnegg overturned Judge Elden Fox’s initial ruling she must stay behind bars until her next court appearance on October 22.
Although Lindsay is a free woman, the judge ruled she must be fitted with a SCRAM alcohol-monitoring device within 24 hours if released.
Lindsay – who served just 13 days of a 90-day jail term in July for violating the probation terms of a 2007 conviction for driving under influence (DUI) – was sent back to prison after she failed two court-ordered drug tests, testing positive for cocaine and amphetamine abuse.
It was widely believed Judge Fox would send the 24-year-old star back to rehab, rather than prison.
However, he made his decision without hearing arguments from lawyers on either side.
Lindsay was said to look “shocked” and glanced at her attorney upon hearing the ruling, before being escorted out of the courtroom in handcuffs.
Lindsay spent just 22 days of a 90-day court-ordered rehab stint following her release from prison in August.

We broke the story … Lindsay tested positive for both cocaine and amphetamines.
And this is interesting … our sources say the D.A. will not make a recommendation when Lindsay appears in court Friday AM.
Lindsay could get 30 days for each failed test.

Lindsay’s Failed Tests Could Derail Upcoming Film
Sources close to the production of Lindsay Lohan’s next project tell TMZ her latest slip-up could throw the movie into serious financial turmoil.
Lindsay is set to star in “Inferno,” a biopic about porn star Linda Lovelace. As we previously reported, one of the things Judge Elden Fox can do in light of her recent failed drug tests is restrict Lindsay’s travel — and “Inferno” is set to shoot in Louisiana.
A source close to the film tells us shooting the picture in Los Angeles instead of Louisiana “would radically change the budget” and force producers to try and secure additional financing.
We’re told the producers might be less inclined to make certain sacrifices for LiLo — the film’s top people are “beyond irritated by the recent developments” and “there is a concern of her commitment to the work.”
Looks like a lot of people have a lot riding on whatever Judge Fox decides.

Lindsay Lohan — Failed Drug Tests Could Ruin Career
Lindsay Lohan has a long-term career problem in the wake of her two failed drug tests — the judge in the case could derail her comeback.
Lindsay is now relying on Judge Elden Fox to allow her to leave California to shoot “Inferno” in Louisiana and possibly fly to New York City for “Saturday Night Live.”
Here’s the problem. Sources connected with the case have been telling TMZ … if Lindsay were to fail a drug test the judge would probably pull the plug on out-of-state-travel — a privilege for Lindsay, not a right.
TMZ broke the story that Lindsay failed two tests … one for cocaine last week.
The judge has been pretty gracious, allowing Lindsay to visit NYC to see her family last weekend. But all bets are off now that Lindsay has flunked two tests.
And sources close to Lindsay somehow already know the big wigs on “Inferno” are pissed that she may have screwed up again, so flying to Louisiana may be a moot question.
As for future projects … good luck getting insurance for a Lindsay Lohan flick.

Lindsay Lohan — One Day to Freedom
Lindsay Lohan may be a free woman in 24 hours … based on new developments in the case.
As TMZ first reported, all signs are pointing to Lindsay Lohan being released from UCLA this week — and we’re hearing it will happen tomorrow. Judge Elden Fox has decided not to issue an order today, but rather he will make a decision tomorrow at 8:30 AM PT.
As we’ve told you, the doctors at UCLA think Judge Marsha Revel’s mandate that Lindsay spend 90 days in rehab is excessive, and they are recommending an early release.
Sources tell us going into last weekend, the plan was for a Wednesday release, and all signs now point to Judge Fox releasing Lindsay tomorrow morning and ordering outpatient care.

Lindsay Lohan — UCLA in 45 Days?
Lindsay Lohan could have an early graduation from UCLA … TMZ has learned … but don’t count on it.
Although the judge ordered Lindsay to spend 90 days in lockdown at UCLA for psychiatric and drug treatment, we’ve learned the inpatient program she’s in typically lasts only 45 days.
When the program ends, the new judge — Elden Fox — could be asked to make a decision on what to do with Lindsay for the remaining 45 days. Judge Fox could release Lindsay from UCLA and place her in outpatient care. But we’re told that’s not a likely scenario.
A medical professional connected with the case tells TMZ it’s “not uncommon” for a patient to repeat a program. In other words, after 45 days, Lindsay would get the same treatment the second time around. The medical professional adds the treatment is not redundant because patients often absorb a lot more the second time.
The medical professional tells us it’s also very possible UCLA would stylize treatment for the remaining 45 days based on unresolved issues.
A source tells TMZ the doctors have not decided exactly how long the inpatient phase of Lindsay’s treatment should last.
Ultimately, Judge Fox would listen and almost certainly follow the doctors’ recommendations.
Lindsay has been at UCLA for 11 days.

Judge Revel Removes Herself From Lindsay’s Case
TMZ has learned … Judge Marsha Revel has removed herself from the Lindsay Lohan case after allegations the judge improperly contacted people involved in the case.
Sources tell us … lawyers in the case met with Judge Revel last Friday at 3:30 PM. Lawyers complained that Judge Revel had contacted “participants and experts” in the case without notifying the lawyers in advance.
We’re told one of the issues — Judge Revel took it upon herself to make contact with people from the Morningside Recovery rehab facility and then selected Morningside, even though it was not on the list of recommended facilities by her own court-appointed experts. Ultimately, Lindsay’s lawyer convinced Judge Revel to send LiLo to UCLA. But the issue was raised on Friday.
Judge Elden Fox – who also presides in Bev Hills — is the new judge on the case.
