Brooke Mueller has gone back to rehab following a crazy week of binging … sources familiar with the situation tell TMZ.
TMZ broke the story… Brooke refused a drug test Friday, which she was required to take as part of her custody settlement with Charlie Sheen.
Sheen’s lawyers are going to court on Tuesday to raise the issue, and we’re told Brooke’s move is a preemptive strike.
Sources say Brooke disappeared for a time this week during her binging. TMZ obtained surveillance video of Brooke attempting to get money for jewelry at an Inglewood pawn shop.

Brooke Mueller is ready, willing and able to take drug tests every week until her kids turn 18 … this according to family members in constant touch with Brooke.
Brooke admits she fell off the wagon in the Bahamas, but claims the events over the last week — especially with Charlie Sheen — have shaken her to the core … and she’s now determined to stay clean and submit to regular testing.
Lawyers for Brooke and Charlie are negotiating today, trying to avert a court battle Tuesday morning.
We’re told Brooke is more than willing to give her lawyers authority to agree to drug testing. As a family source puts it, “She’ll do anything that needs to be done to keep her kids.”

Brooke Mueller will ask a judge to hold Charlie Sheen in contempt of court for blabbing about her alleged drug use … TMZ has learned.
Sources connected with Brooke claim Charlie has squarely violated the divorce settlement he signed, which provides in part, “Charlie agrees to not disclose to any media sources personal information relating to Brooke’s alleged drug usage.”
Charlie has told TMZ, NBC and others that Brooke has been doing drugs.
We’re told Brooke’s lawyers will go back to the family law judge and ask that Charlie be slapped with contempt.
If the judge finds Charlie in contempt, worst case scenario, he could be sentenced to 6 months in jail.

Brooke Mueller feels utterly betrayed by Charlie Sheen, according to her lawyer, Sorrell Trope.
Trope tells TMZ … when Brooke and Charlie signed a property settlement agreement back in May … they agreed to wait a full year before officially filing for divorce. Trope says Brooke made the agreement because “she didn’t want to make trouble for Charlie,” who was in the throws of a trial for allegedly assaulting Brooke in Aspen.
Trope says, “Charlie humiliated Brooke,” by blindsiding her yesterday — filing legal papers without giving her the heads up. And, Trope says, it’s especially hurtful because Brooke had been supportive of Charlie last week during his most recent trouble.
Trope notes that in Charlie’s divorce papers, he suggests the couple’s two kids have been living with him. Trope says it’s not true — the kids have been living with Brooke.

Charlie arrived at the Warner Bros. lot at 10 AM PT today, and when he showed up on the set there were “lots of fist pumps and hugs.” But we’re told no one addressed his wild night in NYC last week, nor the divorce he filed against wife Brooke Mueller yesterday.
Charlie just began rehearsing and on the surface it looked like an ordinary day.

Charlie Sheen filed for divorce Monday because he didn’t want Brooke Mueller yakking about it on her upcoming reality TV show … TMZ has learned.
Sources connected with the couple have told TMZ for months … they would file for divorce as a united front. As we have told you for a long time, Charlie and Brooke signed divorce and property settlement papers back in May and held on to them … waiting for the right moment.
But apparently Brooke’s reality show didn’t sit well with Charlie and he wanted to control the situation and get “a fresh start.” Charlie’s people insist he told Brooke in advance he was filing, but it was not the united front they agreed to last May.

Oksana Grigorieva has just the left the offices of one of the most prominent family law attorneys in Los Angeles — after meeting with him for more than two hours in her ongoing custody war with Mel Gibson.
We’ve learned Oksana has just met with Sorrell Trope — considered one of the toughest family law attorney in the divorce bid. In the past, Trope’s firm has represented the likes of Brooke Mueller, Victoria Hopper, Anna Nicole Smith and Britney Spears.
So far, Oksana has not been able to squeeze more money out of Mel Gibson since she signed the settlement agreement with him back in May — a settlement she is now trying to disavow.
Oksana is currently getting $5,000/month in child support for baby Lucia. TMZ broke the story … her current lawyers are asking the judge to up that to more than $40,000/month, but the judge hasn’t ruled.

Brooke Mueller is MIA from her Los Angeles home — but we’re told what’s behind it all is not rehab … it’s reality.
Brooke’s publicist, Elliot Mintz, confirms to TMZ that Brooke left her L.A. home a week ago and is in an “intensive, physical fitness program in Southern California” — sources tell us Brooke is in the Newport Beach area.
Mintz was quick to add Brooke is not in rehab or any type of “stress management facility.”
Sources tell TMZ Brooke is involved in a cable reality show that will co-star Paris Hilton and others — the theme being “lifestyles.”
Here’s what’s curious — L.A. has a lot of physical fitness facilities/boot camps. So why did she hightail it out of L.A. and over to the O.C. — away from her kids?
Our sources say the kids have been with estranged hubby Charlie Sheen full time for the last week.

TMZ spoke to the Hedgehog who tells us Charlie — who recently spent some time in rehab in the wake of his Christmas Day arrest — was “totally sober” during their time in the house that Hef built.
Ron also tells TMZ, Charlie was smiling and laughing and was overall in a really good mood that night. Shouldn’t come as too much of a surprise … considering Charlie just recently scored the sweetest sentence ever for the Aspen incident involving his wife Brooke Mueller.
Then again, is it even possible to be in a bad mood when you’re at the Playboy mansion?

Charlie Sheen — ‘Train’ Song Sparked Aspen Fight
Charlie Sheen claims the infamous Christmas Day incident with his wife Brooke Mueller all started after she learned that Charlie and one of his daughters shared “an affinity” for a song by the band Train, this according to new legal documents obtained by TMZ.
The Aspen Police Department just released the full police report from the incident, in which the arresting officer states that Charlie explained what happened before the alleged assault.
In the report the officer states, “[Sheen] … explained that he and the daughter share an affinity for both astronomy and the song ‘Drops of Jupiter‘ from the band ‘Train.’”
“[Sheen] added that he bought two tracking telescopes; one for his daughter and one for him so they could both look at the same point in the universe at the same time, as a way of staying connected.”
According to the report, Sheen told the officer that “Mueller was jealous of this relationship with his daughter. He stated that Mueller said, ‘you have a song with you share with your daughter, but not one with me?’”
Sheen told the cops the argument escalated and they eventually started to “slap” at “each others hands or wrists.”
Sheen was eventually arrested for 2nd degree assault, menacing, criminal mischief and domestic violence.

Charlie Sheen has another thing in common with your average college frat boy — dude kept a fake ID in his wallet … one that he claims was made for him “on the set” of one of his projects, this according to a police report just obtained by TMZ.
In the docs, filed by the cop who arrested Sheen after the Christmas Day incident with his wife Brooke Mueller in 2009, it says Sheen was ordered to hand over his ID.
But the officer explains — in the report — that when Sheen handed over the California driver’s license, Sheen told the cop, “It’s fake, I had it made from someone on the set after I lost the real one.”
The cop says he then “confiscated the license.”
It’s a state crime to possess a fake California ID — though it’s unclear why Sheen wasn’t charged for the alleged infraction.

TMZ has learned Charlie Sheen’s actual “jail” sentence will last only seconds.
TMZ broke the story … under the plea deal just approved by the court, Charlie will get a 30-day sentence which will be “administered and executed” at Promises rehab facility in Malibu — where Charlie stayed either full or part-time for more than a month earlier this year.
Sources connected with the case tell TMZ that Charlie will receive credit for “time served” … translation, we’re told Charlie will check into Promises on August 23 and immediately leave.
And it gets even better for Sheen — he’s already completed his 36 hours of anger management, another element of the plea deal.
The plea bargain is a victory for Yale Galanter, who shockingly represents the alleged victim in the case — Brooke Mueller. Galanter ended up negotiating the plea with the Pitkin County DA.

Sources connected with Charlie Sheen and Brooke Mueller tell TMZ now that Charlie’s criminal case in Aspen is over, the deck has been cleared to begin divorce proceedings.
As we first reported back in June, Charlie and Brooke have signed divorce docs spelling out who gets what when their marriage ends.
Sources say they were holding off until Charlie’s Aspen assault case was over, fearing a divorce would give prosecutors ammo in the case.
We’re told almost from the beginning, Brooke has always wanted nothing to do with the case. And now that the case is over, we’re told divorce docs will soon follow.

Sources connected with the Charlie Sheen case tell TMZ the plea bargain is still a 50/50 toss up, hours before today’s court hearing … but one thing is certain — Charlie will not do jail time.
Sources tell TMZ there are two options on the table between Charlie’s lawyer, Yale Galanter, and prosecutors. We’re told neither option includes jail time, and very little or no probation.
But it gets even better for Charlie … he will plead no contest to a misdemeanor — not a felony, and his work schedule on “Two and a Half Men” will not be affected in any way.
We’re told Charlie is in the air right now flying to Aspen, where he and Galanter will meet with prosecutors before going to court.
If they cannot strike a deal, we’re told both sides will ask for a trial date when they appear in court at 3:00PM PDT.
If a deal is struck it will be a remarkable feat — that Brooke Mueller’s lawyer Yale Galanter orchestrated a deal for Charlie that is beyond sweet.

Charlie Sheen’s plea deal is on the verge of being completed — and not a second too soon as he’s due back in court in Aspen, CO this afternoon.
TMZ has learned the final details are still being hammered out, but we know this — the deal will not prevent Charlie from taping a single episode of “c.” Law enforcement sources tell us if Charlie does jail time it won’t interfere with shooting of the show.
Charlie was charged with three crimes — felony menacing, misdemeanor 3rd degree assault and misdemeanor criminal mischief — stemming from the alleged Christmas Day altercation with his wife, Brooke Mueller.
Charlie’s scheduled to be in court at 3:00PM PDT … and TMZ will be live in Aspen.

Sources tell TMZ Brooke Mueller has fallen off the wagon again and she is telling people she’s checking into a rehab facility for 30 days.
Sources say Brooke has been receiving ongoing treatment for substance abuse at her home, but it has not prevented her from slipping, and the signs have been noticeable for those who have recently come in contact with her.
Brooke has been in rehab multiple times for drug and alcohol abuse.

Charlie Sheen and Brooke Mueller signed a 41-page agreement — obtained by TMZ – that lays out who gets what in the event they divorce … and Brooke has made it clear … she’s not going to get less than Denise Richards.
According to the docs, signed by both Charlie and Brooke, they will get joint legal custody of their two kids. Brooke gets primary physical custody and Charlie becomes a weekend dad, getting the kids on the first, third and fifth weekends of the month from Saturday at 10 AM until Monday at 10 AM.
Brooke gets $55,000 a month in child support, plus various other expenses, but, according to the docs, “under no circumstances shall the child support paid by Charlie for Bob and Max be less than the child support paid by Charlie to Denise Richards for Sam and Lola.”
TMZ broke the story … Denise gets $50,000 a month in child support … although the new document suggests Denise may be getting $55k a month.
Brooke waives spousal support but still cashes in. In addition to getting a 50% cut on the baby photos the couple sold to Getty Images, Brooke gets several bank accounts and a lump sum parting gift of $757,689.70.
Charlie gets the house but has to buy Brooke out to the tune of around $1 million.
Charlie also gets to keep his $5.6 mil watch collection.
At the end of the document, Brooke agrees “not to disclose to any media sources personal information relating to Charlie’s sexual affairs or alleged drug usage.” For his part, Charlie agrees not to talk about Brooke’s alleged drug use.

It’s one of the most ironic legal twists in a long time — TMZ has learned the lawyer who cut the very sweet plea deal for Charlie Sheen also represents Brooke Mueller, the alleged victim in the case and the woman Charlie is almost certainly divorcing.
We’ve learned … early on, Charlie’s local lawyer tried in vain to cut a plea deal. Then Yale Galanter, who has deep roots in Aspen, was asked by Charlie’s people back in March if he could help.
Galanter contacted Pitkin County D.A. Marty Beeson, who we’re told initially would only accept a felony plea. Galanter then started wheeling and dealing, even though he was attorney of record for Beeson’s star witness.
It took weeks, but Beeson ultimately agreed to a deal that allowed Charlie to plead no contest to misdemeanor assault and serve around two weeks in jail.
After Beeson agreed to the plea, Galanter went on the hunt to find a place that would meet the criteria for work release. We’re told Galanter worked with the Sheriff and honchos at Theatre Aspen for more than a week, and sealed the deal late Friday.

Charlie Sheen and Brooke Mueller have not only lawyered up for a possible divorce — they are getting all the paperwork ready in case the marriage goes down the toilet … sources tell TMZ.
Sources say Charlie and Brooke acknowledge divorce is a real possibility, but don’t want their business to come out in dribs and drabs in court filings. So lawyers advised them to negotiate the terms of a possible divorce now, get all the paperwork together and then see if the marriage has a chance. If it doesn’t, everything will get filed at once.
We’ve learned Brooke has hired family law attorney Lori Howe in the mega law firm of Trope and Trope. Charlie has hired attorney Mark Gross, a family law expert.

TMZ has learned Charlie Sheen has surrendered legal custody of the two kids he had with Denise Richards.
Sources intimately familiar with the situation tell TMZ … Charlie and Denise signed a written agreement in which Denise now has full legal custody of 6-year-old Sam and 4-year-old Lola. Up to now Charlie and Denise had joint legal custody.
Sources say Denise wanted full legal custody given Charlie’s current marital turmoil, sobriety issues and criminal problems … and Charlie didn’t put up a fight.
We’re told the agreement was signed two weeks ago but the parties didn’t want to file it with the court just yet.
Now that Denise has full legal custody … she can make medical, schooling and other important decisions without getting Charlie’s sign-off. She can also leave the country with the kids without Charlie’s permission.
Under their divorce agreement, Denise has primary physical custody and Charlie has visitation rights.
We’ve learned Charlie has been paying Denise $50,000 a month in child support since their divorce. As we first reported yesterday, according to Brooke Mueller’s prenup with Charlie, she’ll get $55,000 a month in child support plus add-ons — like medical and schooling expenses — and that could drive the monthly support upwards of $125,000.
Calls to attorneys for Charlie and Denise were not returned.

Charlie Sheen and Brooke Mueller have their problems, but, contrary to reports, they have not decided to pull the plug on their marriage — this according to both sides.
Charlie’s rep released a statement to TMZ from the Sheen/Mueller camp, saying, “Please let us clarify this: They are not seeking a divorce nor has one been contemplated. There has been no financial agreements between the parties of any sort. Stories to the contrary are false.”
End of story. At least for now.

Lindsay Lohan’s Dad Going For Conservatorship

TMZ has learned Michael Lohan will be back in L.A. Monday … and he’s telling people he’ll start the legal ball rolling to create a conservatorship for Lindsay Lohan.
Lindsay is in NYC but refuses to see MIchael … and daddy Lohan says it’s now time.
As for a possible conservatorship, Lohan is telling people he’d gladly serve as the conservator but is open to someone else assuming that role.
Michael Lohan also says he does not want his daughter to go to jail. As TMZ first reported, Lohan is on the fast track for a jail cell because she has squarely violated the terms of her probation. A court day of May 20 looms for Lindsay.
Michael wants Lindsay in rehab but not a traditional, group facility. He wants to go the Brooke Mueller route — a private home with lots of doctors. What Michael isn’t factoring in — that type of rehab is bocu expensive and Lindsay is broke.

TMZ has learned Charlie Sheen’s lawyers are deep in plea negotiations with Aspen prosecutors and a deal is close — in large part because Charlie’s show is hanging in the balance.
Sources close to Sheen tell TMZ Charlie’s team has one goal — the plea deal must be made by May 19 … the date of the CBS upfronts, when the fall schedule is announced. We’re told CBS is skittish about re-upping the show if Charlie’s fate is uncertain.
Insiders involved in the contract negotiations tell TMZ it’s increasingly looking like Charlie will cut a new deal with Warner Bros. for two more years of “Two and a Half Men.”
As for the plea deal, sources say there have been “numerous conversations” between Charlie’s lawyers and Aspen prosecutors. As we first reported , the hang-up was over whether Charlie would be pleading guilty to a felony or a misdemeanor.
We’re told it looks like Charlie will end up pleading to one count of misdemeanor criminal mischief for breaking Brooke Mueller’s eyeglasses.

Charlie Sheen’s marriage to Brooke Mueller is on life support, but Brooke has not decided to move out of the house or end the marriage … at least not yet.
“Brooke is absolutely frickin’ ballistic that he is seeing this hooker while she is working on the marriage,” a source very, very close to the situation tells TMZ.
Photos surfaced last week of Charlie wearing a disguise and allegedly leaving a high-end hooker’s apartment, something Charlie’s rep denies.
Several magazines are reporting that Brooke has moved out of the house and the couple is splitting, but we’re told that hasn’t happened. One source says, “Brooke’s stuff is still at the house. She spent the last two days living at a spa, but she hasn’t moved out and she hasn’t split with Charlie.”
The source adds, “She’s absolutely crazed that her children’s father would shave his head, put on a disguise, wearing pajama bottoms and come out of a hooker’s house so that some day his children will see this.”
Brooke is telling people, “I’ve had it” — but we’re told she had not decided to leave Charlie. They are still talking and texting multiple times a day.

Charlie In Trouble

Brittany Ashland – who filed a suit in 1997 alleging the ‘Two and a Half Men’ star attacked her – has reportedly approached Arnold Mordkin, the Pitkin County Deputy District Attorney in charge of the case against Charlie, who is accused of assaulting his wife Brooke Mueller on Christmas Day (25.12.09) and offered to give evidence against him, Radar Online have reported.
Charlie, 44, is expected to plead not guilty to a felony and two misdemeanour charges when he appears in court on March 15.
It was previously reported that the district attorney in charge of the case was keen to interview the actor’s other ex-girlfriend Kelly Preston, as well as former wife Denise Richards.
In 1990, he accidentally shot Kelly – who is now married to John Travolta – in the arm, which led to the end of their engagement, while Denise filed a restraining order in 2006 claiming he’d threatened to kill her.
Charlie – who has 10-month-old twin sons Bob and Max with Brooke and daughters Sam, five, and Lola, four, with Denise – is currently in rehab.
Following Brittany’s 1997 allegations that he grabbed her by the hair and slammed her into a marble floor, knocking her unconscious, Charlie pleaded no contest to misdemeanour battery with serious injury charges and was given a suspended jail sentence.
