Lindsay — Probation Dept. Unswayed By Rehab Stint

Lindsay Lohan’s voluntary stay at the Betty Ford Center isn’t impressing everybody — TMZ has learned the L.A. County Probation Dept. still wants LiLo to serve at least 30 days behind bars for her failed drug test.

Law enforcement sources tell TMZ the Probation Dept does not want Judge Elden Fox to cut LiLo a break during her probation violation hearing today … and will recommend that she serve at least 30 days in jail for testing positive for cocaine after she left her court-ordered rehab stint at UCLA.

The Probation Dept. carries some pretty powerful influence — but in the end, the decision will be up to Judge Fox.

The hearing is set to begin today at 8:30 AM PST — and we’ll be streaming the whole thing live.

Los Angeles Laker Sasha Vujacic just locked down tennis hottie Maria Sharapova … proposing marriage to her with a massive engagement rock to rival any Lakers championship ring.

Sources tell TMZ the pair — who were first spotted holding hands about a year ago — got engaged Tuesday after Sasha popped the question at his home in Manhattan Beach, CA.

Maria’s already been spotted out wearing the ring — we’ve seen it and trust us … even Vanessa Bryant would be impressed by the future Mrs. Vujacic’s ginormous diamond.

In completely unrelated news … Sasha’s been on the Lakers’ bench recovering from a concussion.

The ‘Keeping Up With The Kardashians’ star – who has been single since splitting from NFL player Miles Austin last month – was spotted with the rapper in a Chicago restaurant earlier this week and onlookers claim the pair were all over each other.

One told America’s In Touch magazine: “Kanye had his arm around her all evening! He was rubbing her knee all night – they definitely looked like a couple.”

However, it seems Kanye may have a rival for Kim’s affections as she has also been linked to singer John Mayer.

The 30-year-old socialite was spotted on a date with the renowned ladies’ man in New York recently where sources claim the pair were seeing if they had any chemistry.

One said: “They brought along other friends, but the idea was to see if they would hit it off.”

Now friends claim the date was a success and the couple are planning more outings.

Although it could be that neither man stands a chance as Kim has said she is thrilled to have reached her “flirty” 30s.

The sexy star hit the landmark age yesterday (21.10.10) and rather than be worried about entering the new decade of her life she is very excited.

She wrote on her twitter page: “UH OH The big 3-0!!!! Why does everyone call it The Dirty 30? Its The Flirty 30 to me! LOL (sic)”

Sources connected with Christina Aguilera tell us she split her lip last week after “a simple fall.” As one source said, “It’s as innocent as that.”

There were reports insinuating there may have been domestic violence between Christina and Jordan Bratman, since Christina busted her lip the very same day she filed for divorce.

But as we first reported, there was no domestic violence. Christina just fell on her own.

The TooFab Q&A: Tiffani Thiessen!

Hey guys, welcome to the second edition of The TooFab Q&A, where we interview the most fabulous of stars. Today’s guests: Tiffani Thiessen and celebrity designer Lonni Paul.

Thiessen and Paul, who met while filming an HGTV show, talked to TooFab’s Brian Particelli about their new line of children’s furniture, PetitNest. Plus, the former “Saved by the Bell” and “Beverly Hills 90210″ star talks about motherhood, relocating to NY to film “White Collar” and the new “90210.”

On creating the line, PetitNest …

Tffany: Lonni and I met on “Design Star.” My husband and I picked Lonni to redo one of our rooms, a guest bedroom. I fell in love with what she did and Loni herself. When we wanted to redo other rooms in the house, we hired Loni. I was pregnant at the time and we were designing the nursery. We got to talking about how all the furniture out there was very similar. We came up with the idea of doing this line of furniture on our own. Something that appeals to our tastes, aesthetically.

Lonni: So PetitNest was born. It was a lot of fun. It’s been crazy, the last five months. You have no idea how hard it is to start a company and get it up and running! It was a shocker every day! We launched on 10-10-10 in Las Vegas and it was so amazing to stand back and look at it. There’s been such a great response. It’s been so nice to have people respond like they have.

On decorating a nursery …

Lonni: People tend to, especially when they do children’s rooms, they go in directions they think people should go. Pink and blue. But it’s nice to stay true to the design style of the house and carry that into the nursery. It doesn’t have to be a room that’s so completely different from the rest of the house. You can use all kinds of beautiful colors, fabrics.

The most exciting part of launching their line …

Tiffani: I think, honestly, there have been different levels of excitement. First coming up with the ideas, then the next level was seeing the furniture in front of us thinking ‘Oh my gosh we drew that!’ Then to go to the show and have the response we’ve had. People getting excited about it makes us excited about it. It’s exciting, two women that have other jobs coming up with this idea.

On the next step …

Tiffani: Trying to get the orders out, the PR done and the name out there. All while raising kids, having husbands and other jobs.

Lonni: We’re working on a playroom line for next year to expand the line. PetitNest is all things children.

On moving to NY to film her USA show, “White Collar” …

Tiffani: I live in NY half the year, from April to October. The transition is a lot. I went back to work 6.5 weeks after having the baby. It was a huge ordeal and I was overwhelmed a lot, but I’m glad to be back. I missed everybody. I’m so fortunate to be a part of it. It’ll be nice to have some time off, spend time with Harper [her four month old daughter with husband Brady Smith].

On the new “90210″ …

Tiffani: I watched the pilot, and nothing against the show, I just don’t have time to watch TV. I haven’t watched TV since forever.

The sexy star hit the landmark age today (21.10.10) and rather than be worried about entering the new decade of her life she is very excited.

Accompanied by a picture of her with her friends, she wrote on her twitter page: “UH OH The big 3-0!!!! Why does everyone call it The Dirty 30? Its The Flirty 30 to me! LOL (sic)”

Kim has also been bowled over by all the happy birthday messages she has received from her followers on the micro-blogging site.

She added in another tweet: “I woke up to the sweetest bday messages! Seeing all of your tweets will make me smile all day! I love u guys!!!! (sic)”

Kim was celebrating in New York with friends when the clock struck midnight and she stopped being 29.

Before the actual date, the beautiful socialite had three parties to celebrate the milestone age taking place in Las Vegas, New York and Toronto respectively.

In Las Vegas she partied at exclusive nightspot Tao on October 15 and was presented with a cake, and she received another baked treat while enjoying a birthday meal at a New York restaurant on October 18.

While at Sherway Gardens in Toronto, Canada, she was surprised with a pink and black three-tiered cake adorned with a picture of her on it.

The Council has attacked Miley Cyrus for a sexy music video she recently shot. Papa Cyrus — who we’re told was not consulted before Winter issued his statement — is getting “fed up with the Council.”

Kim K and John Mayer — They’ve Got a Thing Goin’ On

Kim Kardashian and John Mayer have “gone out” together a few times since they were seen hanging out in NYC recently … and sources tell TMZ they’ve totally “hit it off.”

We’re told the story in Page 6 — that the two hung out with a bunch of people in NYC to see if there was any chemistry — is totally true … and after that John and Kim spent a couple of nights hitting the town by themselves.

One source close to Kim tells us it’s “nothing serious” … yet — but she thinks John is a “really cool guy.”

Jesse James’ Ex — Questioned in Liquid Assault

Cops just swarmed in on Jesse James’ ex-wife Janine Lindemulder after she unloaded on a paparazzo … outside of the courthouse in Orange County.

It all went down as Janine was entering court for a child custody hearing — as several photogs followed her and snapped pics.

But it all came to a violent head once Janine got into an elevator — and one photog got too close. Janine — who was holding a warm drink in her hand — swung at the photog, dousing him in liquid .. and sending him reeling backwards into a wall.

O.C. Sheriff’s deputies moved in — and are currently questioning Janine about the incident. The photog is on the way to the hospital.

Sheriff Suggests Prosecuting Oksana is in the Works

The L.A. County Sheriff’s Department has filed legal docs obtained by TMZ … indicating Oksana Grigorieva may well be prosecuted for extortion.

The docs — opposing Oksana’s motion to limit the Sheriff’s access to material in her computer – state, “Evidence obtained from the Hard Drive would be used in a forthcoming criminal prosecution when Detective Wagner’s findings are presented to the District Attorney’s Office.”

In opposing Oksana’s motion, the Sheriff’s Department claims it needs to do a thorough search of Oksana’s computer because, “It is common for evidence to be found on a suspect’s computer and hidden or mis-labeled in a particular computer file.”

Arguments on the search warrant will be heard today at 1:30 PM PT, and we’ll be there.

The pics circulating showing Christina Aguilera with a cut lip are not evidence of domestic violence … TMZ has learned.

Stories are circulating suggesting Christina and hubby Jordan Bratman may have gotten into a domestic squabble and that’s why her lip is cut. But sources directly connected with the couple tell us it was not DV.

The pics were taken October 14 at Mr. Bones Pumpkin Patch in West Hollywood. TMZ broke the story … Christina filed for divorce the very same day. But it wasn’t in any way connected with the injury.

Beyonce Knowles’ mother has denied her daughter is pregnant

The ‘Halo’ hitmaker was reported to be expecting her first child with her hip-hop superstar husband Jay-Z, but her mother Tina Knowles has rubbished the rumours and joked she is having a baby at the age of 56.

Tina said: “The truth is that’s it’s not Beyonce that’s pregnant. It’s me.

“I’m kidding y’all. I’m 56. No, no the reports are not true. Not right now … With all the rumours, by now I should have 5 or 6 grandchildren.”

However, Tina’s claims do not appear to have reached friends of the couple – who married in 2008 – and they have been rushing to express their delight saying they will make wonderful parents.

Record executive Kevin Liles - a close friend of Jay-Z – said: “Jay has been all about family since I met him, and he’s always going to be. I wish them the best.”

Beyonce’s sister Solange added: “She’s got the most beautiful heart. She’ll be a great mom.”

Earlier this year, Beyonce, 29, insisted she would start a family when she is ready.

She said: “My ambition is to continue to learn about the world and to eventually have a family. There are no dates, no times – it will happen when I am ready.”

Kristen Stewart was “surprised” by how comfortable she felt stripping off for her latest movie

The 20-year-old actress – who plays a teenage runaway who becomes a stripper in new film ‘Welcome to the Rileys’ – wasn’t scared about peeling off her clothes or walking around in raunchy outfits because she believes she has matured and was ready for the role.

She said: “I think what surprised me most is probably the fact that I was so unaware of the fact that I was walking down the street with my robe opened and fishnets and beyond caring at all. I wasn’t scared.

“I had known about this for a while before it got up and running. I’m really glad that it took awhile to do so, because I think I was old enough to play the part – as opposed to not ready. I think I would have shied away from too much, so it was shocking to find myself in situations like that, being completely fine with them.”

Kristen had no preconceptions about lap dancers or how they should act but says shooting the movie in New Orleans really helped her get into the role as did the revealing clothes she had to wear.

She added to America’s OK! magazine: “I think what is cool about the costume is you think stripper … I don’t think a whole lot when I think stripper, to be honest. A lot of people have certain ideas about how they must be but I didn’t really have any. But I always imagined they’d be sexy at least or something because that’s sort of their job but it’s on the contrary.”

Kristen visited a strip club for the first time to research her role, and even took pole-dancing classes – which she admits “hurt”.

She added: “I learned how to pole dance, although you never really see it. You do for a second; it’s like in silhouette. It really hurts and you don’t realise, of course, it’s really going to show.”

Oksana’s Bodyguard: We Were REALLY Intimate

Oksana Grigorieva’s bodyguard had an intimate relationship with O.G. since May, and he’s writing a tell-all book that he says will rock the case.

Kristian Herzog — who was recently ordered to stay away from Lucia because of a criminal record involving guns — is telling people connected with the case he was Oksana’s boyfriend for months and still communicates with her on a daily basis.

Herzog is saying he has more than 1,000 text messages and more than 1,000 emails in which he communicates with Oksana about every detail of the case — Mel Gibson, evidence, witnesses, legal strategy and major conflicts between the players.

Herzog certainly had access — we know he was present during virtually every meeting Oksana had with her lawyers.

As for how Herzog can write a book — we’re told he never signed a non-disclosure agreement.

Roseanne’s Ex: She Made Me Pay for Costco!

Roseanne Barr makes $300,000 per month … and she won’t even honor her promise to fly her ex-hubby to Hawaii to visit their kid … this according to new court documents obtained by TMZ.

Ben Thomas — Rosie’s former bodyguard/husband from 1995 to 2002 — claims earlier this year, Roseanne decided she wanted to move to Hawaii with their 15-year-old son. Ben gave Rosie the right to move with their kid, and in exchange Rosie agreed to fly Ben and his new wife to Hawaii every month for 10 days on Rosie’s dime. The whole deal was reduced to writing.

Now, here’s where it gets nasty …

According to legal docs filed in L.A. County Superior Court, Barr canceled Ben’s plane tickets just hours before his first flight … then fired off an email to him saying, “I decided that I’m no longer interested in abiding by this ridiculous arrangement.”

She continues, “You want to visit [our son]? Buy yourself a ticket, book a room … See you in court.”

Ben — who claims his wealth “pales in comparison” to Roseanne’s — says he ultimately paid for his own 1st class tickets to Hawaii … but to even out the cost, he “ate at inexpensive restaurants, rented a Dodge Charger, and filled up with gas at Costco.”

Dude now wants a judge to force Roseanne to honor the deal and reimburse him for the trip — including the Costco run.

Jesse James’ burger joint in Long Beach, CA isn’t going to suffer the same fate as his motorcycle shop — in fact, TMZ has learned Cisco Burger may be expanding … big time.

Sources tell TMZ Cisco Burger is “kicking ass” — and that Jesse not only wants to open up another one in his new hometown of Austin, TX … he also has his eye on expanding the franchise to 100 restaurants around the nation.

This news may be tough to swallow for his crew over at West Coast Choppers in Long Beach — because, as we first reported, Jesse is shutting it down to concentrate on his other bike shop in Austin.

The good news … Cisco Burger will probably be hiring soon.

Gwyneth Paltrow was “really classy” on the set of ‘Glee’.

The Oscar-winning actress has begun filming her guest spot for the musical TV show and her co-stars were very impressed with her performance and attitude.

Harry Shum Jr. – who plays Mike Chang – told E Online: “We shot some stuff with her. She’s been great.

“We kind of just showed up on set and were like, ‘Oh, hi Gwyneth Paltrow.’ She’s really sweet, really classy. You look at someone who’s an Oscar-winning actress and you think they’re going to act a certain way and she’s just a regular person.”

The show’s creator Ryan Murphy has previously said it was a “dream come true” for Gwyneth to appear in the show.

He said: “Gwyneth Paltrow is going to come and do an episode soon, which is amazing. Having her come on the show is pretty much a dream come true – she’s always been one of my dream guests.”

As well as Gwyneth, ‘Vicky Cristina Barcelona’ actor Javier Bardem and Britney Spears are also set to make cameo appearances in series two.

Gloria Allred: I Smell a Meg Whitman Rat

Gloria Allred says she’s been sandbagged by Meg Whitman — in a crass attempt to win the election in spite of the undocumented housekeeper scandal.

Gloria and her client, Nicky Diaz Santillan, Whitman’s former housekeeper, were supposed to appear today before the California Labor Commission … to gripe about Whitman’s refusal to pay Santillan for work she did.

But the hearing was mysteriously continued until November 17 … two weeks after the election. A rep from the State agency tells TMZ … the hearing was continued because Gloria wanted to amend the legal papers she filed with the Labor Commission.

But Gloria is calling BS, claiming she never asked for a continuance and believes this is a power play to get Meg elected Governor.

As for Meg, her camp tells us, “Someone needs to tell Gloria Allred that her political circus has left town.”

Oksana to Sheriff: Lay Off My Stuff!

Oksana Grigorieva wants to block the L.A. County Sheriff from searching her computer in a much bigger way that we were first told … based on new documents obtained by TMZ.

Oksana’s lawyer, Daniel Horowitz, is vehemently objecting to the search warrant Judge Scott Gordon issued, allowing Sheriff’s investigators to search Oksana’s computer for evidence of extortion.

In the docs, Horowitz wants to limit the search to audio recordings of Mel Gibson, photos of Oksana’s facial injuries, emails and text messages between Oksana and Mel. Horowitz is objecting to various other communications between Oksana and her lawyers as well as others that Mel’s side believes constitutes extortion.

Horowitz rails on the extortion investigation, calling it “false.” The core of the allegation is that Oksana tried extorting Mel out of $15 million during their mediation in May, in return for keeping the explosive audiotapes secret.

Horowitz says the real value of Oksana’s deal was only between $1 and $2 million, and “It is not a process of extortion but simply discussion and mild negotiation.”

As for Oksana putting the squeeze on Mel for money, Horowitz says, “These are communications between Mel Gibson and Oksana Grigorieva that are rather normal, civilized and reflect discussions between adults who are genuinely attempting to provide for the financial welfare of their child.”

Horowitz says the Sheriff’s Department has no business looking at pics of Oksana breast feeding Lucia. Likewise, he doesn’t think investigators should be privy to Oksana’s musical works in progress.

And Horowitz claims Mel deceived Oksana back in December, when she signed an agreement basically agreeing to get nothing if they broke up. Horowitz says Mel strong-armed Oksana, telling her not to let “this shi**y agreement be a stumbling block.”

Horowitz, who says his client is a “Russian born, Ukraine raised person” was just following what her experienced lawyers said she should do and “could not be expected to know the technicalities of the law.”

Horowitz will appear in court tomorrow … facing off against the L.A. County Sheriff’s Department … asking the judge to dramatically limit the search of the computer in the extortion investigation.

Eva Longoria — Banged Up in Hollywood Car Wreck

Eva Longoria was behind the wheel during a two car smash-up tonight in Hollywood … TMZ has learned.

According to law enforcement sources, the “Desperate Housewives” hottie was driving on busy Hollywood Blvd when someone suddenly turned in front of her. Eva was unable to avoid the car and collided with it.

We’re told both Eva and the other driver had very minor injuries — no one went to the hospital — and the accident is under investigation … however the early indication is Eva won’t be on the hook for the damage.

Calls to Eva’s rep were not immediately returned.

Man Sues MTV — Rob Dyrdek Called Me ‘Smelly’

MTV is being sued by a man who claims he’s been suffering from shame and embarrassment ever since he was mocked on “Rob Dyrdek’s Fantasy Factory” as a “smelly, old man.”

The lawsuit, filed in L.A. County Superior Court, stems from an episode that ran back in August — in which Rob and his friend try to locate the source of an unpleasant odor … and then point to an old guy limping down the street.

Now the guy is firing back at the network — claiming he never gave permission for MTV to use his image on TV … and demanding they pay up for all of the humiliation he’s been forced to endure.

In fact, the man claims that ever since the show aired “friends and relatives began teasing or mocking [him], buying him air freshener.” With friends like those …

But the man is particularly pissed by the way Rob and Co. allegedly mocked his “gait” — since he claims he’s affected by a medical condition called “spinal stenosis.”

The man wants more than $25,000 for his trouble. A rep from MTV tells us the network does not comment on pending litigation.

Star Jones: I’m Not Mad at Oprah!

Star Jones is fighting back at a report out today in the National Enquirer that claims the former “View” co-host “is furious with Oprah Winfrey for giving Rosie O’Donnell” a show on the talk show queen’s new Oprah Winfrey Network (OWN).

The tabloid cites a source that claims Jones is “shocked” and “angry” that Winfrey approached O’Donnell over her.

But in an exclusive statement to TooFab Wednesday, Jones slammed the report. “Contrary to the fabricated story in the National Enquirer, I am so excited about Rosie O’Donnell’s new show on the Oprah Winfrey Network. Both Rosie and Oprah are dear friends of mine and I can’t wait to celebrate their success.”

And it’s not as if Jones has that much free time on her hands: She’ll be appearing on the upcoming season of Donald Trump’s “Celebrity Apprentice,” alongside La Toya Jackson and Mark McGrath.

Joe Jackson — I Want A Half A Billion Bucks

Michael Jackson’s dad, Joe Jackson, wants somewhere between $10 million and $500 million from Dr. Conrad Murray to compensate him for the loss of his son’s support … this according to new documents obtained by TMZ.

In the docs — part of Joe’s wrongful death lawsuit — he claims the money he seeks is in “the realistic range of provable damages.”

Joe says 20% of his damages are for loss of support, 40% are for emotional distress and 40% are for “loss of comfort, aid, society and companionship.”

And this is huge … Dr. Murray says he’s broke and can’t settle anything because his insurance company is refusing to cover him.

Joe’s lawyer, Brian Oxman, also says he may take the depositions of more than 60 people who have info regarding Jackson’s death.

Dr. Murray says in his new filings he does not want to sit for a deposition until after the criminal case runs its course. It’s a whole 5th Amendment thing.
